For well over a year, the Charities Directorate has been hard at work on important changes that affect how we interact with the charitable sector. A number of these changes have just been introduced, and we thought it would be fitting to send out a special edition of our Newsletter to tell you about them. We would also like to mention the recent release of RC4457, Small and Rural Charities: Making a Difference for Canadians, detailed in the following article “Giving a voice to small and rural charities”, as well as the Charities Partnership and Outreach Program call for proposals for 2008-2009, detailed in the “Charities Partnership and Outreach Program update”, below.
Generally, we have heard that our Client Service phone service is very good, that there is a wealth of information available on our Web site, and that our staff is knowledgeable and professional. We also understand that there is room for improvement in some areas.
We have moved quickly to make changes that will help charities access the information and services they need to understand their roles and meet their obligations. Additional changes and enhancements will be announced over the coming months.
We recognize that the more quickly and easily staff and volunteers can fulfill the necessary requirements, the more time they will have to focus on their charitable work, and this is beneficial to everyone involved. The CRA recognizes that small and rural charities make significant contributions to the well-being of their communities and to all Canadians through their dedication and service. We also understand that small and rural charities face unique challenges that may constrain their ability to meet their regulatory obligations under the Income Tax Act. The Small and Rural Charities Initiative was undertaken to gain a better understanding of these challenges, thereby improving services and processes and reducing the administrative burden for small and rural charities.
The first phase of the Small and Rural Charities Initiative consisted of six one-day workshops in October 2007 with participants representing a cross-section of the small and rural charities. The workshops were held in Toronto, Saskatoon, Lethbridge, Kelowna, Trois-Rivières, and Moncton.
The second phase of the Small and Rural Charities Initiative consisted of three meetings with nine panel members who participated in the first phase. Brian McCauley, the Assistant Commissioner of the Legislative Policy and Regulatory Affairs Branch, chaired the panel which met in November and December 2007 to review and validate the outcomes of the first phase and work collaboratively to develop a joint action plan for the Minister of National Revenue. On June 25, 2008, the Honourable Gordon O'Connor, Minister of National Revenue, met with representatives of the charitable sector for the release of the report: RC4457, Small and Rural Charities: Making a Difference for Canadians, which is now available on the CRA Web site at www.cra.gc.ca/E/pub/tg/rc4457 (you can also call 1‑800-267‑2384 to obtain a copy).
The report includes an ambitious action plan aimed at helping small and rural charities meet their legislative and regulatory obligations more simply and easily. Specifically, the joint action plan proposes activities to be undertaken by the CRA to:
The report is also intended to be an educational resource for the sector. The CRA has included a section on the voluntary sector, highlighting its unique challenges and its contribution to our communities, a section describing how charities are regulated in Canada, and a description of government and sector resources available to the voluntary sector to assist it in both fulfilling its charitable purposes and meeting its administrative and legislative requirements.
You may have noticed a new look and feel to our Web site. We’ve been listening to your suggestions and we’ve created a more efficient, more navigable gateway to the policies, procedures, and legislation that are important to the charitable sector.
We regularly consult with charities to learn where we can improve our services. Additionally, we monitor the types of calls we receive, the types of questions we’re asked at our Charities Information Sessions, and the types of issues identified during audits.
The feedback we receive most often from charities and other stakeholders is that while there is plenty of information available on our Web site, finding simple answers and explanations to everyday questions can be a challenge.

The information provided on our new Web pages is clear, focused, and concise. You should get the answers you need quickly and easily. However, you may want more details on your topic, or you may wish to review our official policy statement on a particular procedure or regulation. Therefore, each topic includes links to corresponding definitions, publications, and policy statements.
You may also have noticed that topics formerly displayed on the left‑hand side of the screen have been regrouped into centre boxes in a more logical and structured order, as seen below.

Given that some charities do not have high‑speed Internet, most of our guides are available in both PDF and HTML formats. Documents in HTML format are Web‑based, load faster than those in PDF, and are more convenient to navigate online. You can print the pages you need using HTML. If you want to print the whole document, you should use the PDF version.
So take a look yourself. We hope that you’ll find our new Web pages easier to navigate, allowing you to find the answers to your questions quickly.

The CRA has recently provided charities with checklists to ensure they are aware of reporting obligations, reporting timelines and how to protect their registered status, in accordance with its commitments owing to the report RC4457, Small and Rural Charities: Making a Difference for Canadians. The checklists address key compliance issues-not only for small and rural charities, but for all charities.
Two copies of the Basic Guidelines Checklist, which outlines key obligations for registered charities, have been sent to all registered charities. One copy of the Basic Guidelines Checklist is for the charity’s board of directors, so it is aware of, and fully understands, the legal responsibilities related to operating a registered charity in Canada. The second copy is for the person responsible for maintaining the charity’s books and records and filing Form T3010, Registered Charity Information Return.

This document sets out the proposed policy of the CRA’s Charities Directorate concerning the reporting guidelines for fundraising expenses and the process and considerations for determining whether a registered charity’s fundraising is acceptable.

The purpose of this guide is to help ethnocultural organizations understand the requirements and responsibilities associated with applying for, and becoming, a registered charity.
The Charities Partnership and Outreach Program is designed to provide contribution funding to registered charities and non‑profit organizations serving the charitable sector in Canada to assist in developing and delivering innovative compliance‑related education and training projects for charities.
The Charities Directorate of the Canada Revenue Agency (CRA) is accepting funding proposals for the Charities Partnership and Outreach Program. The overall objective of this program is to increase charitable sector compliance with relevant parts of the Income Tax Act.

The last year that information and invitations for the Charities Information Sessions were sent by mail was 2007. Starting in 2008, all information about the Charities Information Sessions is available through the Web site, or by calling the Charities Directorate Client Service Section at 1‑800‑267‑2384. If you haven’t yet subscribed to the electronic mailing list, do so now to make sure you don’t miss out on this year’s sessions.

This is a reminder that, effective January 2009, the Charities Directorate will discontinue print and mail‑out of Guide T4033A, Completing the Registered Charity Information Return, to all registered charities. However, the CRA’s Charities and Giving Web site at www.cra.gc.ca/charities will continue to offer the electronic version of the guide, as well as many other forms and publications.
The Registered Charity Information Return (Form T3010) and schedules that currently form part of the guide will continue to be printed and mailed out as usual. Registered charities that do not have access to the Internet and require a paper copy of the guide, or that need assistance finding and working with Guide T4033A online, can call the Charities Directorate Client Service Section at 1‑800‑267‑2384.
This worksheet is now being sent out with the T3010 packages to private foundations only. Private foundations that hold more than 2% of the issued and outstanding shares of any class of shares of a corporation at any time during their first fiscal periods beginning after March 18, 2007, must complete the worksheet. Generally, private foundations with fiscal periods ending March 31, 2008, will be the first to receive this new worksheet.
Note: Charitable organizations and public foundations will not be receiving the Excess Corporate Holdings Worksheet.
The Charities Directorate anticipates introducing a new Registered Charity Information Return (Form T3010B) in 2009. We have divided the information on Form T3010B between a simple core form and topic‑related schedules to make the form easier to use. We anticipate the re‑designed form will relieve the filing burden for smaller charities in particular. It will also provide the public with more meaningful information about registered charities to allow them to make more informed donor decisions.
Keep an eye out for the release of the new Application to Register a Charity Under the Income Tax Act (Form T2050), and its companion Guide T4063, Registering a Charity for Income Tax Purposes. Form T2050 is being revised in accordance with certain legislative amendments, and to address the form’s general ease of use. Guide T4063 is being revised to put need‑to‑know information about the advantages, requirements, and obligations of registered charities front and centre, in order to facilitate the process of applying for charitable registration under the Income Tax Act.
